These Terms of Service ("Terms") govern your use of SocialPilot.Ai ("we," "our," or "us"), including our website at socialpilot-ai.com and the SocialPilot AI client portal (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Service Description

SocialPilot.Ai is an AI-powered social media content creation and publishing platform designed for small and medium businesses. Our service includes:

  • AI-generated social media content (captions, images, videos, carousels)
  • Scheduled publishing to connected social media platforms
  • Performance analytics and engagement reporting
  • A client portal for reviewing, approving, and managing content
  • AI avatar video creation (optional feature)
  • Brand onboarding and strategy consulting

Accounts & Access

  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized use of your account
  • You must provide accurate and complete information when creating an account
  • Accounts are for business use only and may not be shared with unauthorized third parties
  • We reserve the right to suspend or terminate accounts that violate these Terms

Client Responsibilities

By using our Service, you agree to:

  • Provide accurate business information, brand guidelines, and content direction during onboarding
  • Review AI-generated content before publication and take responsibility for any content published through your connected accounts
  • Ensure you have the right to use any logos, images, or brand materials you provide to us
  • Comply with the terms of service of all social media platforms connected to the Service
  • Not use the Service to publish content that is unlawful, defamatory, obscene, harassing, or otherwise harmful
  • Not use the Service for spam, automated bulk messaging, or any activity that violates platform policies

Content Ownership & License

Your Content

You retain ownership of all business information, brand materials, logos, and imagery you provide to us. You grant us a limited license to use this material solely for the purpose of providing the Service to you.

AI-Generated Content

Content generated by our AI on your behalf (captions, scripts, posts, videos) is yours to use for your business. You are responsible for ensuring all published content complies with applicable laws, platform policies, and industry regulations.

Our Platform

All software, design, workflows, and intellectual property related to the SocialPilot.Ai platform remain our exclusive property. You may not copy, reverse-engineer, or redistribute any part of our platform.

Payment & Billing

  • Fees are billed on a monthly basis as agreed upon in your service agreement
  • Payment is due upon invoice. Failure to pay may result in suspension of service
  • We reserve the right to adjust pricing with 30 days written notice to active clients
  • Refunds are not provided for partial months of service unless otherwise agreed in writing
  • Clients are responsible for any applicable taxes on fees charged

Social Media Platform Compliance

Our Service integrates with third-party social media platforms (Meta, LinkedIn, TikTok, YouTube, X/Twitter). By connecting your accounts:

  • You authorize us to publish content and retrieve analytics on your behalf using the permissions you grant
  • You remain responsible for ensuring your use of each platform complies with that platform's own terms of service
  • We are not responsible for changes to third-party platform APIs, policies, or availability that may affect the Service
  • You can revoke our access to any connected platform at any time through that platform's settings

Disclaimers & Limitations

No Performance Guarantee

We do not guarantee specific results, follower growth, engagement rates, or business outcomes from use of the Service. Social media performance depends on many factors outside our control.

AI Content Accuracy

AI-generated content may occasionally contain inaccuracies. You are responsible for reviewing content before it is published and for any content that goes live under your accounts.

Service Availability

We strive to keep the Service available but do not guarantee 100% uptime. Scheduled maintenance or unforeseen issues may cause temporary interruptions.

Limitation of Liability

To the maximum extent permitted by law, SocialPilot.Ai shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability to you shall not exceed the fees paid in the three months preceding any claim.

Termination

  • Either party may terminate the service agreement with 30 days written notice unless otherwise specified in your service agreement
  • We may terminate or suspend your account immediately for material violations of these Terms
  • Upon termination, your access to the portal will be revoked and we will delete your data within 30 days
  • Outstanding payment obligations survive termination

Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms will be resolved through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised date. Material changes will be communicated via email to active clients. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
